Farmatseut Terms of Sale and Use Valid from 2 July 2026

1. Validity and scope of the terms of sale

1.1. These terms of sale and use (hereinafter the Terms) govern the rights and obligations arising between customers of the Farmatseut online store (hereinafter the Buyer) and DuoMedics OÜ (hereinafter Farmatseut) upon the purchase of goods (hereinafter the Product or Products).

1.2. In addition to these Terms, the legal relationships arising from the purchase of Products from the Farmatseut online store are governed by the legislation in force in the Republic of Estonia.

1.3. Farmatseut reserves the right to make changes to the Terms, sales prices, delivery methods and campaign conditions. Changes are published on the website www.farmatseut.com.

1.4. By placing an order, the Buyer confirms that they have read and accepted the Terms and undertake to comply with them.

1.5. The Products sold in the online store are intended for ordinary personal use, unless otherwise indicated with the particular Product.

2. Prices

2.1. All prices in the Farmatseut online store are in euros and include value added tax at the rate applicable in Estonia.

2.2. Displayed discount percentages may be rounded to a whole number.

2.3. The price and availability of a Product may change on an ongoing basis and without prior notice. If, after the order has been placed, it becomes evident that the price or availability was incorrect due to a technical error, Farmatseut will contact the Buyer at the earliest opportunity.

2.4. If an ordered Product is not available or the order cannot be fulfilled, the amount paid is refunded to the Buyer without delay, but no later than within 14 days of sending the corresponding notice.

3. Placing an order and payment

3.1. Products that can be purchased from the Farmatseut website are those bearing an “Add to cart” button.

3.2. The Buyer may change Product quantities and remove Products in the shopping cart before the order is finally confirmed.

3.3. Before placing the order, a suitable delivery method must be selected and the accuracy of the entered data verified.

3.4. For orders of 50 euros or more, delivery within Estonia is free of charge, unless otherwise indicated in the online store.

3.5. To place the order, press the “Buy” button, and to confirm the order, press the “Pay” button.

3.6. The order can be paid for securely through Maksekeskus AS, using the payment methods offered in the online store.

3.7. When paying by bank link, after completing the payment you must press the “Back to merchant” button on the bank's page.

3.8. The contract enters into force once the amount payable has been received in Farmatseut's bank account.

3.9. The owner of the online store is the controller of personal data and forwards the personal data required for carrying out payments to the authorised processor Maksekeskus AS.

4. Entry into force of the contract of sale

4.1. The Buyer becomes bound by the order and its payment after pressing the “Pay” button.

4.2. The contract of sale is deemed concluded from the moment the amount paid for the order has been received in the bank account of DuoMedics OÜ.

5. Delivery and handover of Products

5.1. After the contract of sale enters into force, Farmatseut assembles the order and hands it over to a logistics partner or prepares it for handover to the Buyer.

5.2. Ordinary delivery time in Estonia is generally 3–5 working days from the entry into force of the contract of sale.

5.3. In some cases delivery may take 7–10 working days.

5.4. Delivery may take longer if the supply of the Product to Farmatseut is delayed due to the manufacturer, factory, importer, logistics partner or other circumstances beyond Farmatseut's control. In such a case Farmatseut will inform the Buyer within a reasonable time of the possible delay and the new expected delivery time.

5.5. In exceptional cases Farmatseut has the right to deliver the goods within up to 45 calendar days.

5.6. To ensure delivery without delay, the Buyer must carefully check the accuracy of the contact and delivery details provided in the order.

5.7. Farmatseut is not liable for a delay in delivery where the Products were handed over to the logistics partner on time but the delay is caused by circumstances that Farmatseut could not influence or foresee.

5.8. For receiving the goods, the Buyer has the options displayed in the online store, including parcel machine, courier service or collection in person, where such an option is available when placing the order.

5.9. Shipping costs are borne by the Buyer, unless otherwise indicated in the online store. The relevant price information is displayed next to the delivery method.

5.10. By mutual agreement, Farmatseut may also deliver to other countries, where this has been agreed in the online store or separately between the parties.

6. Right of withdrawal and returns

6.1. Products purchased from the Farmatseut online store are subject to a 14-day right of withdrawal from receipt of the goods, except in the cases provided by law and in these Terms.

6.2. The withdrawal period ends 14 days after the day on which the Buyer, or a third party designated by the Buyer other than the carrier, has taken physical possession of the Product.

6.3. To exercise the right of withdrawal, the Buyer must send a corresponding declaration to the e-mail address info@farmatseut.com no later than 14 days from receipt of the Product.

6.4. The Buyer must return the Product without delay, but no later than within 14 days from the day on which the Buyer gave notice of withdrawal.

6.5. Farmatseut refunds the value of the returned Product to the Buyer without delay, but no later than within 14 days of receiving the declaration of withdrawal, provided that Farmatseut has received the Product back or the Buyer has provided proof of having sent the Product back.

6.6. There is no right of withdrawal in the cases provided by law, including where the Buyer has been supplied a Product in sealed packaging which is not suitable for return for reasons of health protection or hygiene and which has been opened after delivery.

6.7. DermaSilk products fall under the exception described in clause 6.6. DermaSilk products are sealed antibacterial class I medical devices and cannot be returned or resold once the packaging has been opened, except where the Product is defective or does not conform to the terms of the contract.

6.8. If the Buyer wishes to avoid compensating for a decrease in the value of the Product, the Product must be handled and tried out only to the extent necessary to establish the nature, characteristics and functioning of the Product in the same way as would be permitted in a physical store.

6.9. If the value of a returned Product has decreased because the Buyer has used the Product more than was necessary to establish its nature, characteristics and functioning, Farmatseut has the right to deduct the corresponding decrease in value from the amount refunded.

6.10. Products are not subject to return where they have been made to the Buyer's personal specifications, mixed or combined with another product in a way that no longer allows them to be separated, or used for the purposes of economic or professional activity, unless otherwise provided by law.

6.11. Where a Product is defective, incorrect or does not match its description, the 14-day right of withdrawal does not limit the Buyer's statutory rights to submit a claim in respect of a Product that does not conform to the terms of the contract.

7. Use of the purchased Product for economic or professional purposes

7.1. Where the Product is used for the purposes of economic or professional activity, or the buyer is a legal person, the right of withdrawal provided for consumers does not apply to the same extent as it does for a consumer.

7.2. In such cases, claims are resolved primarily on the basis of the manufacturer's warranty, the agreements between the parties and the applicable law.

8. Liability and the procedure for submitting claims

8.1. Farmatseut is liable for the non-conformity or defect of a Product sold to the Buyer in accordance with the applicable law.

8.2. The Buyer has the right to submit a claim concerning a defective Product within two years of the Product being handed over to the consumer, provided that the defect did not arise through the fault of the Buyer.

8.3. The claim must be submitted within a reasonable time after the defect is discovered, to the e-mail address info@farmatseut.com or by another means made available by Farmatseut.

8.4. When submitting a claim, the Buyer's name, contact details, the date of the complaint, the defect of the Product and the claim being made must be stated, and proof of purchase attached where possible.

8.5. Where an expert assessment or diagnostics are required in order to establish the nature of the Product's defect, Farmatseut may ask the Buyer to return or hand over the defective Product.

8.6. Farmatseut responds to a claim in writing within 15 days of receiving it. If a response within that period is not possible, the Buyer is notified together with the reasons and a new deadline.

8.7. Farmatseut is not liable for defects arising through the fault of the Buyer, from incorrect use, incorrect storage, negligence or ordinary wear and tear of the Product.

8.8. Products damaged in transit — but not merely damaged outer packaging — are replaced where possible. Where replacement is not possible, the amount paid for the defective Product is refunded to the Buyer.

8.9. The Buyer has the right to turn to the Estonian Consumer Protection and Technical Regulatory Authority or the Consumer Disputes Committee where a dispute cannot be resolved by agreement.

9. Force majeure

9.1. Farmatseut is not liable for damage or for a delay in delivery where this is caused by force majeure or other circumstances beyond Farmatseut's control that could not be foreseen or influenced.

10. Processing of personal data, security and marketing

10.1. All of the Buyer's personal data is processed in accordance with Farmatseut's privacy policy, available on the website www.farmatseut.com.

10.2. Encrypted data communication channels and appropriate technical and organisational security measures help protect the Buyer's personal data and payment details.

10.3. Farmatseut may send the Buyer transactional messages relating to an order by e-mail, telephone or SMS where this is necessary for confirming, fulfilling or delivering the order or for providing customer support.

10.4. Where the Buyer has given consent, or where permitted under applicable law within an existing customer relationship for offering similar products or services, Farmatseut may send the Buyer marketing messages by e-mail and SMS.

10.5. The Buyer has the right to opt out of marketing messages at any time, using the unsubscribe link in the e-mail, the opt-out option indicated in the SMS, or by writing to info@farmatseut.com.

10.6. Subscribing to marketing e-mail or SMS is not a precondition for purchasing from the online store, except where a specific campaign or discount is directly linked to such a subscription and this has been clearly disclosed to the Buyer.

11. Other terms

11.1. Product images are illustrative.

11.2. Product descriptions are checked and supplemented regularly, but the information may have changed since the Buyer's last visit.

11.3. Farmatseut reserves the right to withdraw from the sale and refund the money paid by the Buyer where fulfilling the order proves impossible due to a pricing error, a stock error, the manufacturer's supply difficulties or another reasonable cause.

11.4. If any provision of the Terms proves to be void or unenforceable, this does not affect the validity of the remaining Terms.
